Question.  Since I'm in a tough situation, how does charging a double nonrefundable deposit sound?  Plus lease termination for smoking?  that my be a bit harsh..

yes yes, the evils of buying a bad property.  I think we all have done this.  My lesson learned;  Don't by small properties in a  bad area.  Just too early in my career to know it was a bad house.

 That's a good point.  Never thought about the friends smoking.  I think I'm going to pass on this one.  I've actually never rented to a smoker so I have no experience.  In my 11 years, I've always just passed.  My mentor told me NEVER to rent to smokers and it has been good advice so far.  But it would be bad having a vacancy during the holidays.

@Kris Haskins I'm sure she'll still end up smoking inside. And even if your lease states that you'll end the lease if you notice smoke during an inspection, you'll still have to go through the eviction process. And that might be a challenge to convince a judge that you can prove she's smoking inside by smelling it and kicking her out.

Other than the smell, how does her current home look? Clean? Tidy? Is it dingy? Would you be terribly repulsed if your unit looks like her current unit looks after 7 years or is it pretty good for that length of time for a renter?

 Well, here's pic, oh by the way, thnx to all that chimed in...   It has new carpet and paint.  

I never thought about having to convince a judge, I thought I'd just end her lease.  I'm sure I can have a witness that can come and testify as well.  This unit always gives me a hard time...

I have a rental that's in a challenged area.  SO far, my best applicant is a section 8 tenant where gov't pays 90% of rent.  I visited her current home, where she's been for 7 years, and it reaks of smoke.  We agreed she would smoke outside if I approved her lease and also agreed to sign an affidavit to terminate her lease if there was smoke present during our quarterly inspections.  I typically pass on smokers but has anybody had luck with smokers only smoking outside?

Ok BP, I'd like to share with you a story about a local rehabber that has a wonderful house on the market.  But the risks with this business are never as easy as just the house.  We all miss huge key points to a house from time to time and this one is just massive.   Let us all remember the house is just 1 aspect of the flip.  The neighbors are crucial too.  

There's a 50 unit building behind the house which you can't see from the street nor on the google maps.

HEY BP, we still have a ton of short sales in our market in the Hampton Roads Area.  It's been this way for about 5 years, and it's going strong.  I was in Richmond recently and the short sales were low.  Please tell me whether the number of short sales in your market are high or low as I think our market is extremely unique due to the high volume of military.  I don't think the majority of US have high short sales like we do but I'm trying to get a feel for other markets??

For the Rich and famous I have bought those as well  ( well at least sports stars) and I will mention one by name since he is deceased.. I bought Jerome Kersey's mansion on the Williamette river in Oregon... he had gotten tied in with a financial consultant that lost him a lot of money.. He had Lots of child support to pay to many different mothers that added to serious dollars.  and his home was 3/4 done we paid 1.8 mil for it ( he was losing it to Wells fargo back in 2004 so it was a hot RE market but not a lot of folks could cut 1.8 mil checks and close in 10 days.  WE then put 1.2 million into it and resold it at 5 million to the CEO of precision Die cast  a Portland based fortune 500 company.  Jerome got wiped out.  Now he did get back into basket ball with executive jobs he was well loved in the community and the times I interacted with him he was a gentlemen and I could tell a kind sole.. but he did not have the necessary financial education and he trusted the wrong people and he lost his fortune.. And we know this is quite common in pro sports.  So lifestyle ,  choose wrong money manger ( and did not have enough financial education to vette his own investments) led to a complete loss of his wealth.. and a start over. 

 that was a nice post. I'm not sure why there are so many judgemental investors here but I believe we all have our faults. My friend had so much cash coming in every month I believe he never thought it would stop coming. the older I get I realizemoney is a biproduct of your knowledge and how much value you bring to the marketplace.

are you asking for an insurance agent? Or are you asking for a good insurance company? From what you have written and the way I am interpreting it is I believe you may need a monthly vacant house insurance policy. If so we use national real estate insurance group they are getting some good exposure out here on the East Coast but I'm not sure if they offer coverage in your area. we also have monthly builders risk policies too.it is a wonderful real estate investor friendly company good luck
