In all my reading on BP and numerous books on REI - I've never heard of this approach being used.

I recently evicted a tenant in NC who wrote me two bad checks. They were arrested and charged with felony fraud as the amounts totaled over $2k. Didn't even have to hire a lawyer, filled out a few papers with a magistrate and mailed the tenant a demand letter. If they don't pay within 14 days warrants are issued. The officers went straight to their place of work and arrested them.

Made the mistake of accepting a personal check for a security deposit/prorated rent. Of course, that bounced. Second rent check bounced as well. Had to immediately evict. All in, I lost $5K in rent and attorney fees. After the sheriff physically removed the tenant from the property and padlocked the door, the tenant came back days later, drilled through the locks, and moved themselves back in. Found out about the break in a day later, called the police who charged her with breaking/entering, criminal trespass, obtaining property by false pretense, and two counts of fraud. During this time, she also wrote a bad check for $30K to a car dealership. Earned a grand theft auto and third fraud charge for that. She ate the charges in court last month and is being sentenced at the end of October. Luckily for her, she will not have to pay rent in jail.

Recently, I was forced to evict a tenant. Upon moving out, they accumulated nearly $6k in debt (past due rent, utilities, cleaning, attorney fees, etc.). As of now, I'm tossing around the idea of suing for money damages. Currently, my lawyer is estimating a cost of about $1K to file, win, and enforce a judgment. Being that the property is located in NC, I cannot garnish their wages. My only option is to have the sheriff seize their personal property and sell it post judgment. The tenant owns no real property (homes, cars) that the sheriff can seize, however, they do have quite a few expensive furnishings. Is it worth pursuing a judgment or should I write the debt off?

Thanks for the replies. I originally hired a company to clean the carpet, however, the hose would not reach the unit. Ended up receiving a recommendation for the Bissell Pro Heat Revolution 2X Pet, which I purchased. It did a fairly descent job. All the stains were lifted and the high traffic areas look about 75% better. Next cleaning I plan on pretreating the high traffic areas to remove the remaining dirt.

In my personal opinion, the problem in China is much greater than what we saw in '07-'08. Real estate development has exceeded population growth by 300%. Their debt has also grown significantly. In November '08, they launched a quasi-fiscal stimulus equating to 12.6% of GDP. To give you an idea of the enormity of this, TARP was 4.8% of '08 GDP and ARRA was 5.5% of '09 GDP.

If China has a hard landing, the consequences for developed nations will be fairly severe and emerging markets will get hit even harder. From what we saw in August '15 and January of '16, for every 10% equity drop in China, we tend to lose 2.5-5% of our equity markets.

Since you're in NC like myself, you'll have to post a 10 day pay or vacate notice. I just went through a very similar situation last month. Had a tenant who made every promise to pay, but never received a dollar. If the property is in Charlotte, I can recommend a great attorney who handles my evictions.

Also, you may want to put a clause in your lease waving the 10 day pay or vacate notice. NC requires it by law, however, you can waive it if it's noted in the lease. Spoke with a magistrate in court last month and she confirmed. If you need the clause, PM me.

I use rentec.com. You can pull just an eviction report and skip credit, criminal, etc. It's not expensive at all, I believe the eviction report is $7.

I understand why landlords choose to participate in cash for keys, but I won't. Right or wrong, I feel like it's my obligation to evict someone for breaking my lease. The last thing I want is for my problem child tenant to get away clean and move into your unit.
