Investment Info:

Single-family residence buy & hold investment in San Jose.

Purchase price: $1,400,004
Cash invested: $150,000

1700 sq ft house on a 10,000 sqft lot. Converting the garage into a JADU, that will become an STR/MTR. Will be building another house in the backyard after splitting the lot using SB9.

If the garage conversion is the only ADU that you plan to add (ever), you are better off classifying it as an ADU than a JADU. JADUs require owner occupancy (OO) to rent. In the event that the owner is not owner occupying the property, the JADU loses its status as a unit. A jurisdiction can require modifications to make is less a unit (example typically is to reduce kitchen). An ADU does not require OO to be rented and will always be a unit. The downside of classifying the garage conversion as an ADU is a SFH typically can only have one ADU and one JADU. If you classify the garage conversion as an ADU, it likely means you cannot add another ADU.

Do your research prior to proceeding so that you are confident you are making the best choice for you.

Thank you for your valuable input. I don't want to apply for an ADU or JADU permit, if possible, because of the reasons you mentioned. I have a big backyard (accessible through a cul-de-sac) and planning to use SB9 for lot-split, but if that doesn't pan out, I might build an ADU in my backyard, so definitely don't want to apply for an ADU for my garage space conversion.

I was going through the permit history and found that there was a permit applied for a game room addition which I guess was for the garage conversion. I emailed SJPermit enquiring about the same but have not heard back yet. 

Suppose it turned out the conversion was permitted, can I apply for a building permit to install an access door without going through ADU or JADU permitting process? The previous owner also build an attached bathroom to the garage space, so the plan was to just install a kitchenette there and rent it out as a studio. Do you think that is a good plan? Thank you again for your input.

@Jason Gettler, Any update on your SB9 lot split project? 

I am kind of in the same boat, bought my sfh this year in San Jose, which meets all SB9 requirements (corner lot, 10,000 SF lot size). Planning to build a new house in the backyard (access through cul-de-sac) using SB-9. I already enquired with my lender about the partial lien release, and they asked me to wait for 1 year of loan completion, after which they will look into my partial lien release application. No doubt lots and lots of unknowns, and not entirely sure if it will work out in the end.

Would love to learn from your experience if you don't mind sharing it. Thanks in advance.
