Brian Woodson Your assignment fee must go on HUD 1 on buyers side there is no way around this unless you do a double close/simultaneous closing.

Chris Burgess Whoever has the property under contract is going to be the wholesaler and has a equitable interest to market property. Find out who this person is and see if they are willing to partner on deal, if you can bring them a cash buyer. Usually they will have a JV contract. Make sure you get a copy of JV contract and P/S contract they have with seller, once your cash buyer signs assignment form and submits their EMD.

Samantha M. That's why there is the EMD aka (consideration). If a buyer does not perform and close, they forfeit their EMD. A seller can not make you buy their property... However if you do put a property under contract you should do what you say you would do.
Samantha, Are you making offers on bank owned properties and do you feel the same way about telling the bank or your realtor your exit strategy?
