@Matt Devincenzo Thanks for sharing your story. In my case, there are canceled checks and deposit history from my bank that I have shown to the underwriter. The mortgage loan person I spoke to at my bank yesterday says that should suffice. But, somehow, it doesn't. I have gotten an email from my roommate cc'ing the loan processor stating that she does not want to supply her statements to third party. Anyhow, this seems to be beyond my control at this point.
@Mary B. Thanks for the suggestion for future loans. Right now, I need to get the underwriter to accept what I have (her canceled checks and deposit slips copies) . My roommate as made a statement to the underwriter that she does not want to supply her bank statements to them.

@Bill Gulley Thanks for your thorough reply. I understand that the underwriters have to be able to document everything. I understand that for auditing purposes. I am frustrated that my roommate isn't working with me here. I've offered her dinner, monetary compensation for her time, anything that she deems fair for this favor to me but she just hasn't replied. Yes, I know tax accountants are busy right now but, I'm running of patience. Beyond that, I can't get over why the canceled checks, my deposit statements and bank statements would not be sufficient? It states clearly that it is a check coming from her account into mine every month, with the routing number, account numbers, bank institustion, etc.. It just seems like the underwriter is asking for the exact same thing, twice. Unfortunately, in this case it appears that I cannot provide the documents from the roommate's end :/ This is out of my control. I can't force her to do what she doesn't want to do.

@Deborah Smith I understand that. I haven't seen her at all. In fact, I believe I heard her come back around 1am two nights ago but that was the last time I heard or seen her presence.
What kills me is that the underwriter is giving me just two days to get this done. Closing date of the escrow is coming up this week. Ugh! I can't believe this is the ONLY issue with my loan.

@Bill Gulley In the five years that we've lived here, we've never had a late payment. I pay the full rent to the landlord and the roommate pays me half. The underwriter wants not only to see my deposits and canceled check, the underwriter wants to see her withdrawals. She is not available. I haven't been able to reach her the past couple of days. But, why are the canceled checks and deposit statements on my end not sufficient? Btw, I have offered my roommate dinner and pay for her 20 minutes to go to Wells Fargo but she has not replied to me at all. This is so frustrating.

So, does anyone here have a real estate attorney who can consult me with my question on whether this is fair that the underwriter is requesting the financial documents of someone who is not on the loan?

@Thomas Weir Thanks for your feedback. I really don't get it.. they've made me jump through so many hurdles already and they tell me this is the last thing they need. I am beyond frustrated. It just does NOT make any sense since the canceled checks show exactly where the funds are coming from. The lender is MB Financial.
@Wayne Brooks That sound ludicrous that they can ask for anything. There should be reasonable boundaries, especially when it comes to other people's financial bank statements. Roommate is not applying for the loan. It sounds ridiculous that she has to supply her statements. This just seems wrong.
