@Jay Hinrichs I like the timber  talk scenario lol .  You know it's really not even about the money that I lost I think I put more value on the morals of people and just common courtesy had he called me and let me know something that he had another buyer that was willing to pay him or at least give me a chance to know what was going on. We could have all worked out something to where the new buyer could buy the property I back away from the deal and I'll be compensated for what I have already invested. So I'm not crying over 600 bucks but  what irks the heck out of me is that this guy knows ethics he's a retired attorney.

@Sarah Ziehr the seller countered my inital offer and i accepted their counter offer. This seller was just straight out wrong he could have let me know something you don't just go behind someone's back and accept a new offer and sign a new contract after I help solve all your problems and you have a pending sales contract with me and open title. 

 I have filed my memorandum of agreement today so we'll see what comes out of this.

@Guy Gimenez Good advice >I include a provision in my contracts clearly stating the seller acknowledges and agrees that I have the right to record the contract or a memorandum of same. That way, the seller can't complain that your memo has clouded their title.

If you can please.... type it out what you exactly say in the provisions. So we all can learn a bit. Or if you prefer I can inbox you.

@Guy Gimenez THANK YOU ! for those words of wisdom. Thats really in the end I just want to protect myself from future snakes and etc. And you are absolutely right, about interfering with a contract. Besides a clouded title, is there a way to be compensated for your work, as in my case i was mentioning about the breach of contract fee in a clause. You think that works. This particualr case the bill in pulling records and etc was a little over $600 + so far not including title opening fee. So now im stuck with a bill, thats part I dont like. and neither one of them mention hey sabrina, I tell you what Ill take the deal but let me compensate you. SOMETHING !!! I would never do this i dont care if its $100K deal for profit.

@Glenn Banks good point, so let me say this, whats your thoughts? 

When I add in the clause into the sales agreement the BREACH OF CONTRACT FEE of $2000 - seller should not enter into any agreements to sell this property or circumvent the buyers rights to purchase the property at LOT 3 LOT 21 Sesame Gardens also known as 1234 Ripple Lane Houston Texas 77000 blah blah blah , and the SELLER SIGNS that contract, will that make it binding at that point. So my memorandum is really by lobster trap, if anyone trys to open title - the memo shows up in the deed chain. ??? 

What are you thinking? :)

@Steve Vaughan Thank you, Yes at this point I don't ever want to force the sale with that snake seller, I would have been content with a breach of contract fee paid, however I didn't have that clause in my sales agreement initially. Moving forward you bet ! I will on every sale. I can't take another lost like this. That's why I can to share this with others because it can happen, and you should stop it now while you can.

@Jay Hinrichs OH BOY LOL - That's harsh : buyers are liars, sellers are liars, wholesalers are liars everyone has an agenda...

I like to change that and INSERT THE WORD "SOME"

I don't think like that, there are good people out there who are sellers, buyers, and wholesalers, and realtors & brokers.

@Brit Foshee & @Matt Motil - I'm a drama free type. And I understand that forcing a sale with a NOW ugly seller will be slightly uncomfortable, BUT 

Have you guys ever had experience with filing a Affidavit and Memo of Agreement Concerning Real Estate- Basically it's filed in the county with the REAL PROPERTY records and according to the legal description of the property LOT & BLK etc. So if a new title is open it will show the MEMO/AFFIDAVIT in the Deed Chain, and a QUIT CLAIM deed will have to be sign by YOU to release your current equity in the property. In addition by adding a breach of contract fee clause into your special provisions of the sales agreement. This will force the title company to cure the cloud and pay your fee.

@Matt Motil I did have this property under contract LOL - OF COURSE I DID ! Thats how I opened title with the sales contract.
