@Jason Rivera thanks for the advice. Thats what i was hoping for a vet investor who has some creative pixie dust to let me know what can be done.
The break in title is caused by a deed executed in 1977 the father sign the deed to his daughter but moms signture was not on the deed. Mom was sick at the time: so when mom died in 1978. She passed with remaining interest in the property. So that means her kids alllll have an interest even though their intent was to give it to their daughter (jane)
Jane is passed away and the proeprty has been sold 2 times with general warranty deed without a title company just a cash deal with deed title transfer. So now here it is 2016 and i cant get a title company to issue a policy because of moms unaccounted for interest in the property.

ABSOLUTELY It can be a deal .
Since The Lacy is the executor on the estate, if there was no will directing the property to be willed to anyone. Then she has the right to sell the property, but only at the time the judge signs off to finalize the probate. HOWEVER you can tell the judge the time sensitive situation about the pre foreclosure and the urgency to sell the property , the judge will 99% give them a quick order approval to sell the property.
Also it would be wise to see if the NIECE (deceased) had kids. Because you definitely want to ensure that their interest in the property is accounted for. ( do they want to sell or keep it)
If she has no kids, does she have a husband
if she has no kids no husband and NO WILL directing the property to be given to anyone
THEN you can move forward with some creative structuring.
If the property is willed to another person then you need deal with that person. not the executor.
I understand the bank wont talk to anyone because they are not the owner, find out if any family member had a Power Of Attorney over the niece. That would work, for the bank .
Then you can get a reinstatement quote from the Bank so you can know exact amount she is behind with fee and etc.
From there your exit will be a subject to - then you can wholesale it

#2. You can definitely pull this deal together with the right team, as long as the numbers make sense and not cents. LOL
#3. At least you know at the very least you can wholesale it out to a commercial buyer
#4. I say Jump in and learn from it. think about it whats the worse that can happen.

@David DachteraYes YEs Yes !!! I can remember when I started, I thought it was find a deal and boom sell it. I thought I was easy as buying and reselling an item on ebay. BOY OH BOY ! there is so much mystery to each deal, you never know what might jump out at you. Title issues, will stop a sale in its tracks, uncooperative heirs its just surprises. Yet exciting! I know for certain real estate is not for the faint at heart.
But if you like a challenge and a thrill and big checks, Real Estate is Your Best Friend.
