From my experience this is how the opening of the call happen 8 out of 10 times.( PROBATE)

Let it be known 99% of my marketing is Direct Outbound Phone Calls, The other 1% is Mail Out only when necessary. So when I'm calling the seller/heir and I get a voicemail, I leave the curious message, then SAVE their number in my phone as .....

First Name : Susan  

Last Name: 1234 Ripple St. 

Company: (use this area to type in notes about the case) ex: Probate: Beatrice Val. $150K Offer$75K

That way when my phone rings I can see who it is and case notes quickly.

( the call below is an outcome when the seller/heir is not ready to sell for whatever reason, I didnt write a call flow for when a seller/heir wants to sell, because you know if they want to sell it NUMBERS time and you have the seller on the hook. I wanted to show a call flow thats most likely with a probate case upon first contact, because your fortune will be in the follow up. Sometimes the heir spill the beans and tell you all about the family dirty laundry and any disputes about selling etc. Some are more like Susan and just straight shooters.)

You: Hello This is William!

Seller: Hi William this is Susan, I got your message/letter so I was returning your call.

You: Yes! Susan I'm glad you called me back, We'll first let me ask, How are you today?

Seller: I'm fine thanks for asking.

You: We'll Susan the reason for call  ( or ) We'll Susan the reason I sent you a letter. Is because I work with families during the probate phase. I understand sometimes the responsibility can be  overwhelming with paying off unpaid bills, so I was reaching out to you to see if the property off  of 1234 Ripple St. would be up for sale? If so I would like to buy it cash.

Seller: Well the house is my grandmothers house and we have not decided what we're going to do yet.  If we decide to sell I will call you. 

NOTE:  ( at this time you can't let the call go you have to PROBE)

You: I totally understand Susan, sometimes these matters can take time and a decision from the whole family. May I ask Susan, are you the person in charge of the estate, the executor?

Seller: Yes I am, 

NOTE: ( at this point you are trying to make sure you are talking to the head honcho, if not you need to get in touch with them, you will know who the honcho is because susan will reveal this ) 

You: Okay great Susan, could you please save my number in your phone that way soon as you make a decision about the house you can call me.

Seller: Yes I will 

You: We'll thank you Susan so much for your time, if you have any questions just give me a call. Is it okay If I follow back up with you say ...... in about a week or so? 

Seller: Yes that will be fine. 

You: Susan have a peaceful week and thank you again for you time. Talk to you soon.

@William Corcoran Thanks for posting. I understand you want to get everything out in the open. But...

Just as a RESUME is to GET the interview not the job. 

The letter is to GET the callback not the deal.

The Interview determines the outcome of getting the Job.

The the callback determines the outcome of getting the deal

Does that make sense?

@Dell Schlabach Read my post Again! I didnt try to convince him to get an llc, i advise him to go the most affordable route, thats best for his wholesaling business. DBA at the least.

I strictly said its NOT THE LAW- 

Anyone who is buying and holding real estate needs to have an LLC to protect their investment. No its not Required By Law - But who advises someone to not protect themselves. Thats just non sense. As @Laura Petree mentioned Law Suit Crazy could possibly tear down your personal life if you dont have an LLC

@Luis Perez Contact a local real estate attorney and just ask. 

In the meantime do your first deal - first!

1. Send the letter to the address ( all you can do it TRY) 

2. Run the name of the ower in the Appraisal District and see if he owns any other property, that possibly could reveal his current address. 

3. Run the name in the county clerk ASSUMED NAMES and see if he has filed any DBA or business related docs, that could show clues to his current address.

4.Run his name in the marriage query as see if he remarried or etc, you will see the current address where the marriage license was mailed.

5. You could take your chances with. www.Spokeo.com or www.findtheseller.com/

1. Make sure its a deal and the numbers make sense. If you have it already under contract and are strong about your ability to wholesale it ( numbers make sense) then your next step is the SECURE YOUR FEARS ( someone else buying it while you are away) 

You need to file a MEMORANDUM of Agreement Concerning Real Estate 

see my file here: 

This will lock your deal in with a cloud on the title until you close on it. No other buyer can open title without clearing this cloud with your permission ( you file a release) . That will cure your fears, of the seller giving your deal to someone else.

NOTE: If you do not plan to close on it, then you need not file this document. 

With the MEMO filed you can continue working on the deal and marketing it online while overseas.

As long as you close within 45 days I don't see anything wrong with going overseas. No rush To Sell

@William Corcoran I agree with @Rick H. 

First thing is we need to see your letter. You could be saying to much or not saying the write words.

1. Since you mentioned you are cross checking the appraisal district to see if the deceased had any real property, thats a good first step, 

2. I would pull the probate case and see who has been the designated executor ( the person who controls the estate) This person is likely listed their name and address. As well the Attorney who is handling the probate case. With this information you have 2 more chances to make a connection with this family in some way, 

       A. Send a letter to the executor - My opinion you need to send CURIOUS MAIL - position yourself less as an investor and make the language curious so they call you out of curiosity. Once you get them on the phone then you can reveal you are an investor. I know this WORKS because I have tested it time and time, and 90% or more it works. On the phone as voice message and in a letter. Its written using FIRST NAME only for a reason, and worded in this fashion for a reason, to provoke the reader to suggest that you are someone THEY MUST KNOW and need to call back. ( you are important) 

                              Hi, Susan 

It's William please give me call at 555-5555. I couldn't find your number so I thought I take my chances and send a letter. I hope this letter finds you in good spirits as I know Beatrice, has just passed. I'm not sure of the family plans and if you need any help regarding the estate. Please give me a call Susan, as soon this letter reaches you. 

Sincerely, 

William 

B. Call the attorney on the case and try to touch basis with him/her and let them know you are an interested cash buyer,if the family is interested in liquidating any real property from the estate of Mrs. Beatrice Doe. See what the attorney says, if the rapport is good on the phone, mention to the attorney that if he has any other clients who need to liquidate you would highly be interested in purchasing any real property. ( he may just be your bird dog)

As far as TEXAS and the title company I work with. At least a DBA in your company name is required (but not the law) to WHOLESALE. If you are buying to invest, hold, flip etc. An LLC is needed.

Especially when you are collecting a huge wholesale fee like $8K plus on a deal. ( at the least use a DBA thats about $15 bucks give or take, and looks more professional when you are contracting with sellers and in the business of Finding & Assigning .

@Rachel Pervis my time is whats most valuable the time i spent on clearing and working this case , is time i cant get back , time i could have spent with my kids or etc. I spent all day at the courthouse 1 day in the real property records curing the title. And I just cant let an educated attorney think he can just jip people around, plus he hung up in my face when i told his new buyer the truth. So both of them knew the truth and both response was greed. 

I want to thank everyone for commenting and giving me support on this matter. To hear from different views really help me. I will keep you guys posted on the outcome.
