@Brian Garlington Right!! I can't understand it.  Our lawyer sent a notice to cease and section 8 won't do anything. I'm just looking for loopholes because other than moving in because I don't want to live in the home.

@Arlen Chou Hi Arlen. We are under month to month but under Oakland law, Just cause applies and she can only leave if she violates the lease.... but then the courts aren't really in the favor of landlords. I'm trying to find some type of loophole.

HI @Nathan Gesner Thank you for the thorough reply. Unfortunately, I did hire one of the best Eviction attorneys in Oakland. He was in shock when the judge asked if the tenant could stay despite not paying rent for 6 months.  So that's why I posted this thread. But as far as a Property manager, I'm going to take your advice on right away. Thank you!

If you're in california, I would weigh my options. I have a section 8 tenant in oakland and she is horrifying and I can't remove her because California laws are tenant friendly. But my mother's friend of 30 years has been on section 8 for over a decade because she's disabled and keeps her home immaculate. Do extensive background checks and referrals. If you're in a landlord friendly state, use your due diligence. 

Hello all,

I have a section 8 tenant in my single family home in West Oakland, California. The tenant has been there for 3 years and the section 8 office is of no support. We have been to court 3 times. The first 2 times she took me to small claims (she lost) and the 3rd I served her an eviction notice for 6 months of unpaid rent ( she pays 75% of the rent, S8 pays the rest). The judge asked if she could stay even after not paying rent for 6 mos. Now she's currently destroying the home by flushing tampons and pads down the toilet to get the plumber out every week, she's sabotaging appliances to get maintenance to come out 3-4 times a month. She lied about mold, she destroyed a 3 year old water heater ( her bf is a plumber and he lives there against the contract) and she continues to pay the rent in portions and late. She is horrifying and I don't know how to get her out.  Oakland is very tenant friendly fyi.
