Yes I have an attorney but I already know what he's going to say. Check with the title company. Lol. I learned years ago that they are typically the final say on these types of matters. Not necessarily your attorney.

Hi All. Are there Any title companies out there known to allow some sort of affidavits from heirs to suffice for an official probating of an estate?

I understand that typically title companies like to see in the estate probated and a legal representative appointed before a property can be conveyed from the estate to another party. However I have seen rare instances, many years ago, where a title company allowed affidavits from heirs to take the place of an actual probate.

Any national title companies out there that might allow such a thing? In my particular case, the decedent passed away as a resident of Mississippi but owns a property in New jersey. Thanks in advance.

One thing that wasn't mentioned was payments. hopefully you're staying ahead of your contractors with your payments. In other words your only paying for work that was done and not paying for work that hasn't yet been done.

There's also your attorney fee. Particularly if you're in North Jersey we're using attorneys are customary.

On a side note, if the property is three units or more or owned by a business entity, you will have to get a bulk sale exemption from trenton. Your attorney or the buyer's attorney will typically handle this.

You can check the County Probate Office for a file of the wife if there is one. You can also find out her date of death and search for her obituary. if she had children they should be mentioned there. Good luck.
