Totally legal, I close them all the time as the Escrow Holder.

Why not create a Trust or some entity that will allow the son to be in control while giving the mom the ability to move the equity to a new property and not have tax implications? For example, "Joe Smith, Trustee of the Mom Smith Trust" shows Joe as the acting person but it is Mom's ownership.

There is no secure, streamlined way to communicate with all parties. Email is the easiest way to do it and it is overwhelming sometimes but it is the best option, no other alternatives. Keyword being SECURE and ALL PARTIES...you can get a lender on their portal and a title company on theirs, but there is no one place that everyone accepts as a "hub" to communicate that is not specific to a company.

Without knowing the terms of the contract, my suggestion if you are trying to get out of the deal is to use to inability to get an appraisal, which in turn is your inability to get a loan. This might get your EMD released, again depending on the contract terms.

Temecula Valley is a hard area because these are almost all owner-occupied or tenants with pride of ownership mentalities, not a lot of fixers. I have one client who flips this area and it's a slow process. I would think Hemet, Menifee and such had more opportunity for true flipping. This area is driven by retail buyers, who are not likely to deal with the wholesalers, either.

I think a buy and hold is the most likely to succeed from what my clients tell me.
