Thanks everyone for the feedback. I was seriously considering billing this back to the tenant until I read @Jon Holdman post and my wife essentially told me the same thing. I didn't explicitly show the tenant how to use them as I'm out of state but I did explain them to them. Like Jon said, things a lot of the time gets lost in translation. I'll eat the cost on this one. I was assured by the HVAC guy he thoroughly explained the dampers and how they work to the tenants so this shouldn't occur again. 

I was also a supporter of the maintenance fee deductible but after reading on it some more, I now believe its a bad idea as tenants are more likely not to report serious issues which in turn will cause the LL a serious outlay in cash eventually. Thanks again for all of the feedback!

My tenant contacted me late last night saying the heat wasn't blowing upstairs but it was downstairs. As this used to be my primary residence I immediately knew it was the dampers. I asked the tenant if they checked the dampers and she assured me her husband had checked it multiple times and the hot air still wouldn't blow upstairs. Long story short, HVAC guy came out and opened the upstairs damper. $175 for diagnostic and actually opening the damper... I looked over my lease and it doesn't address service calls at all. How do I approach this. I would assume this is general tenant maintenance.

I've been having a discussion with some friends on FaceBook about when rent is late. I use Cozy for rent collection for my Maryland property. My tenant didn't start the Cozy transfer until today, October 1st. My FB friends said since she started the transfer on the first, the rent is not late. I said, the funds aren't in my account and there is no promise that the transaction will go thru so therefore I constitute the rent being late. I'm curious to hear from you guys your perspective on this.  

This is easy. Tell the tenant that they didn't pay you for May's rent. After 10 days, service the tenant with a 10 day pay or quit. I PROMISE you the tenant will be on the former LL like white on rice. THEY will go to the police and file a report for theft it it comes to that. The LL will cave at the thought of being thrown in jail and will promptly pay it back. If this is someone with anything going on in life, this is the way the situation will play out.

Great insight and I believe you're spot on with your analysis! I am originally from Memphis and all of this rings true. I have one rental there currently. The Memphis market definitely isn't for the faint of heart and its easy to loose your shirt there!

Derrick has been my property manager for a property I have in Memphis for the past 3 years. He is very professional and always gets the job done right the first time. He is always quick to tell me of tenant complaints and has a crew ready to fix issues that have arisen at my location. He is a prompt collector of rents and pays me thru paypal the same day rent is collected. I have never bought a property from him but I can tell you his work is top notch and far exceeds some other rehabbers in the area. Lastly, Derrick is willing to manage in parts of Memphis that other PM's consider not so safe. Most make this assumption based on zip code and out dated crime stats found online. Memphis is one of those cities where you must takes things street by street and not make a generalization about an entire area. Derrick, being a Memphis native, has that experience and expertise. I highly recommend him.

We are building a house in Arlington, TX. The contract states that mineral rights don't come with the property which is standard. I wanted to know does anyone have any experience buying the mineral rights from the builder? The house in in Tarrant County, Arlington area. Apparently we are on some shale formation but there is no way an oil company could set up a drilling rig in our community as it's small and is slated to only have around 30 houses.

What about the 35% fee every year that the lease is renewed. That's a new one for me. I've never heard of that one.
