Certainly consult with an attorney, but if, for example, you had a contractor doing some work that indicated in writing there was a strong smell of smoke, this could be used in court during a for cause eviction.

I will say, an eviction should still show up on a court record search as long as you got the applicants identification.I understand the apprehension behind not wanting to rent to people without social security numbers.

Eviction isn't a great option here- I think you'd have major problems in court proving which tenant caused this issue or if it were tenant caused at all.
