I would like to use the name Realty in new company I form but I do not have any real estate licence, is that okay? I do not want to mislead anyone to think I'm licence.

Thanks,

Ron.

Read the FL RE licensing laws, Florida statutes 475.

@Ron K. if it is likely that the average consumer would look at your marketing and be mislead with regard to your business purpose or offering then it is a risk.

In the state of Maryland where I live, a licensed agent can not use the word realty unless they own their own brokerage. Unlicensed people can use it in their company name but may not advertise the name.

Thank you guys, I see it's not that simple. Maybe I'll add in smaller print " we are investors not a licensed real estate company"

You can use the word realty as long as you do not provide services that require a license. You could open "star realty" as an example, buy and sell all the houses, commercial, land you own, etc as long as YOU OWN the property. Perfectly legal. This is legal in Florida as long as you are not providing license required services for others such as marketing, selling, managing, etc. Provide services for another without a license, that is a third degree felony.

I Believe Realty is free to use while "Realtor" is the prohibited one.

You can absolutely use the word "Realty". I know an investor who has several LLC's with the word "Realty" in the name. It's just another word in the dictionary. However, you cannot use the word "Realtor" as it is trademarked by the National Association of Realtors and they will sue your ***.

Too risky, regardless of the state you are on shaky ground. Be cautious always, that is my philosophy. I know many would disagree.
