@Matthew Olszak I definitely understand your stance. But I don't know if it's pride on my part, I try to take a "stance of power" anytime I deal with these jokers now

I don't even want to tell them "I'll hear them" or "I'll try to work with them" and get taken advantage of again....

I'm more inclined to say, "the sheriff will be seeing you and we're going to court, if you want to work it out to dismiss you can call me"

Let me know your thoughts...

@Beth H. why did they decline? What happened?

@Brent Coombs you're right, I earned his business cuz he just got out of an eviction. Coincidentally he didn't collect on his PREVIOUS judgment either when ex tenant fled.

Thanks for the comments. I see it chanted ad nauseum about "soft landlords" on these forums "file on the 10th", "no exceptions", etc etc etc...

That's not that question and I've ALREADY FILED.

But I'm in a good area and screen hard, so this is the FIRST TIME I've actually had to file....

Unfortunately this is one of the more "frugal" client landlords (and maybe not coincidentally my first)...

I had to rent this townhome with stained carpets, broken fridge, damaged kitchen flooring and more.....

Of the terrible prospects he had, he incidentally picked one with roommates/family members with bad credit and no rental history

So it's no surprise to me we're in this situation, but I find myself at ends arguing to save him time and money from the courts.

@Mike Cumbie great tip to wait for them to be OUT before dismissing.... thanks

Now I've left a message with the tenants at their WORK.... and still getting the dodge, despite trying to give an out..... to dismiss if they leave in two weeks.

im not sure where the thread got off track. The question isn't about PM professionalism or whether the tenant should be evicted or not. 

The question is whether to advise my client against his wishes, but in his best interest, to settle out of court.

@Brent Coombs what do you lose by actually filing? if not actually gaining a lot of leverage on your defaulted tenant....?

Unfortunately, our tenant decided not to pay anymore with 2 months left on his lease....

so I'm READY with the papers to FILE for failure to pay tomorrow at district court....

But I just called my client and told him... "hey maybe we can talk to the tenants and tell them we'll drop eviction if they leave by the end of the month"...... save the head ache and time....

Client thinks courts is the best way to go as if money will be guaranteed to him.....

Can you help me think of other arguments against GOING TO COURT?!?!?!

I assume you're looking to buy and hold, not flip.

Look at the comps in rentals, what are they going for? Who's renting them?

Military or school nearby?

Low income is not bad if you do the research.

Bad idea to take rent in advance. You don't know if his new career choice in his first week is trafficking sex slaves through austin....

Or if he has a nice habit of blasting music at midnight....

You get the point.....

Someone without a steady full time job/school has proven trouble to me in tenants with too much time on their hands....

yes, i can see how that would be frustrating.

the applicant can't be too angry about it because i'm sure he knows having pitbulls is restricted most places... i wouldn't worry about it too much

what service do you use to post? I'm surprised you got allt he way to application without mention of a dog...

even if it's specified in the ad I want to know about pets, what kind etc.
