@Thuy Pham-Satrappe also confused what 5k is going to do. No one is going to remediate and replace siding on even a small house for 5k. Something is off with these facts

@Thuy Pham-Satrappe you can get normal insurance that doesn’t charge extra for asbestos siding. Looks like you got bad advice. I’m also assuming there is no way this property is in San Clemente

@Theresa Harris Yes, but what I am saying is their commission, and thus incentive, is so low, especially on cheap properties, that sometimes if they think you are a tire kicker or an otherwise a non-serious buyer who is unknown to them they will often not deal with you directly.  They also may have preferred buyers they will market a property to first for a round-trip commission before they will want to talk to you.

@Pamela LEE REO agents are notorious for poor service because they are often on a super low commission structures with the bank(s) in return for repeat business. I've stated this before and been attacked by angry REO agents but the truth remains extant. Poor service is normal in this area as there motivation is low

@Thaddeus Goodgame sounds like you got mislead by an incompetent or deceptive realtor on your resale price. Happens all the time as they are trying to close a deal.

@Maria D. Scott text isn’t verbal, text is written. It may or not be binding, however small claims court is based on equity so best to bring your case there.

@Anthony Wick I agree with you, the lease is the place to start and then from there, see if it’s enforceable. Also even if it is enforceable these type of things get tried in small claims court, which is a court of subjective “equity” not law per se. So even if the law is clear you never know what some wacky judge might determine. Also I wasn’t referring to you as one of the ignorant posters, you seem to have very good and experienced opinions on things. There are a couple of guys on this thread that chimed in that I’ve seen consistently give dumb advice based on suspect land-lording experience.

@Anthony Wick they likely aren’t getting $1,500 for the fridge simply because that’s not the fair market depreciated replacement value relevant to the broken fridge. that isn’t inherently contra to what I’m talking about. State and local rental laws usually specifically dictate the responsibility of the landlord with regards to who is responsible for repairs of appliances that are provided by the landlord. Here in Portland I have to fix or replace any appliance I provide regardless of what I put in my lease. So again simply pretending landlords can add any phrase in there lease and it’s legally binding is naive. By the way this is also how it works in most contract law not just rental agreements.
