@Cory Lucas YES! Make it contingent upon the current owner having the tenant completely out and their move out repairs complete for the return of the security deposit if there is one. You don't want to pick up in the middle of that. 

And I hail for the mountains but of a costal state. Our rents are extremely high and vacancies are next to none.

@Brandon Blankman, man that is a tough place to be in. You would want to check with what the laws are in your area. Here, you would have to go through the courts to get the old tenant out. In a situation like this it may be a good idea to really open up communication with old tenant and see if you can get a solid feel for why their deal fell through. If it was due to financing issues they may not be able to move as soon as you think. If it is with issues with the inspection that they are trying to negotiate it may just be a delay.

@Alex T. It's tough to say. If the owner of property B has good reason for it the judge may side with them. If they have hired a lawyer they seem pretty serious in the fact they don't want this to be changed. Best of luck...it's hard to predict what the outcome will be.

@Cory Lucas If the tenant is being evicted it may be for the best. Sometimes taking over a tenant/lease you are left with holes so to speak. If you move forward you can place your own tenant hopefully quickly at the price you have stated it was renting for. I wish rents were that cheap in our area! Best of luck.

This is a tough one. I think a sit down with a VP or President at that title company is in order. They may have procedures in place that might help put your mind at ease.

I would ask for full documentation about all of this. Involved your broker if you had one as well. They can file a lawsuit even for funds owed from their mistake.

I would recommenced interviewing at least 5 brokerages before you commit to one. Make sure to ask about desk fees, what's included in those fees. The 50/50 split seems high even for starting out but the 95/5 after $16k is pretty nice.

Jose - if it is including in the rent and the landlord is paying for it yes it should show in the operating section. But they may have it included with other utilities or under another line item.

Kyle - I have only read up on this briefly - Are you already charging your tenants for the utilities? The way I am reading this is that their lease would be renewed and if this is not already implemented in their lease you may hit a bump in the road. I may be reading this incorrectly though. My best advice would be to have an attorney look over your current lease and let you know how to legally go about doing this.
