Property: California

Was a trust recorded incorrectly if it was filed as 2nd owner, leaving the original individual owner as 1st owner?

This is a personal matter where the original owner's new wife is not to be trusted.  Yet, she is the one that had the trust written and recorded.  The original owner is in his late 70's and his memory & cognitive function is on the decline.  She has lied and been very "crafty" with matters in the past and we just don't feel good about how controlling she is.

It's a revocable trust.

When he passes, can it be processed the same as if it were a property with a trust recorded as the only owner?  Or, will this create a problem for the beneficiaries of the trust?

@Ryan Phillips reading through some of this thread as I'm trying to figure out how to "wholesale" a HUD deal. By any chance, did you ever end up partnering on a deal as you described here inn your original post? Did you end up either seeing a contract or putting one together along these lines?

I use Call Tools and while it has a nice UI - I'm not thrilled about it.  My skiptracing populates up to 10 phone numbers and I hate that I have to pause to delete contacts.  I did work at a company once that used XenCall and the transition to it was a nightmare. UI very unfriendly and support was super slow.I guess it's impossible to have the perfect system.

Also, it was a bit of a drag that I had to switch to Firefox with Call Tools.  Something about Chrome where it just won't work very well.

Giancarlo, any chance you can please show me how to create that script?  I'm new and trying my best to be as efficient as possible.

I wonder if it's the same property.  I was told by the neighbor that the man had no family here.  I did research and it looks like there is no mortgage on it. I did a people search/background report and it did not find any family members. The 1st phone number is disconnected.  The next two are wrong numbers. I was told by someone I can go the route of Adverse Possession.  I'll have to look into that further. 

I came across a property in Orange County, CA where the owner passed away last year. Property is not under a trust. Neighbor told me he was from Europe with no family here. I did a peoplefinders search and did not find any family members. There is no mortgage on it.  Is there any way to acquire this property?   I came across a mention that i can run a genealogy report and take that to the court and purchase it from the county.  However, I'm not sure if that's something that can be done in California.

If the seller won't entertain this and must sell and close immediately, you'll have to assess the strength of the deal and determine if you think it's worth it to inherit a potentially challenging situation with the squatters. You'll just want to budget for the cost of holding the property and dealing with the challenges of vacating the squatters yourself. 

Additionally, you can explore the option of incentivizing the squatters to leave. Sometimes, they will leave immediately for a certain dollar figure. While not ideal, this can be a simpler and more profitable option. Hope this helps!

Hey everyone! I'm new here and just getting started. Thank you in advance for any advise.

This may be a dumb question but I know Covid might be an x factor:

Potential deal where there is a squatter.  Seller told me they just got served yesterday.  She is motivated to sell.  

Should I wait until squatters are evicted to make an offer?  Or should I make an offer now?

Asking because I keep hearing how Covid is making it harder to evict. Also, trying to make an offer ASAP before someone beats me to it. 

Other factors: 

- property is in Orange County

- house is significantly smaller than average for the neighborhood (good size lot)

I am aware that this would make it a less than favorable wholesale deal for me to flip.  I just don't know how investors deal with this or if it's an absolute deal breaker.
