Not sure if you sorted your ITIN yet but I applied for my own ITIN. It was just a matter of completing the W-7 and mailing it back to the IRS. No 3rd party required.

If it is LLC on what documents did you use Notary?

The Notary was used for a lending document for the LLC. I showed my operating agreement to the Notary to provide proof I was able to sign documents on the LLC's behalf.

However, that was a separate matter from forming the LLC. There was no paperwork required when forming the LLC as my Attorney set it up online.

I cannot comment on the Trust aspect of the structure. But in my opinion, you may be making matters more complicated than they need to be.

Unless you are looking at starting your investment with a significant amount of properties, an LLC based in the state you will invest in owned by yourself and your wife may suffice. Ensure each property is adequately insured and that you have a registered/statutory agent for your LLC.

I can speak from experience that in Ohio, using an Australian Notary Public is acceptable. No Apostille was required either.

I understand it's best to stay north of Dorr St as the area around UT can be patchy.

I personally own in 43613.
