If your lease with the tenants stated they are responsible for this bill, I'd suggest you pay it right away to avoid the lean and include it as part of the security deposit settlement process.

At this point having been there for so long, even without a lease, I'd presume you need to go through the proper measures of serving a 60 day notice to vacate. If she doesn't vacate at that point - you could open the eviction. 

As mentioned above however I'd suggest a legal team on your side to provide the proper notices and handle everything accordingly.

@Will Gaston Unfortunately denying some due to the emotional support animal could get you in trouble if they report to Fair Housing - we have even gotten into a debate with Fair Housing about an emotional support pot belly pig before. We use petscreening.com to verify the legitimacy of the ESA - hopefully your insurance would accept this documentation and screening as well as proof.

This specifically mentions 30 and 60 day notices. It does use the term eviction throughout as people are mentioning in this chain, but I’d presume it’s better to be safe than sorry and have a just cause on your notices to vacate. If a tenant pushes back and brings up COVID in court I’d presume judges will favor tenants as they so often do.

Got it, from a legal standpoint you are a bit stuck if they want to proceed forward, however a conversation with them explaining your situation may resolve the issue though. They may be understanding and simply agree to terminate the agreement, just be sure you document all of this with them in writing if they agree.

@Estefania Concha Unfortunately your tenant is correct in the fact that you must have a "tenant at fault just cause" currently due to the tenant protection programs...normally this does not apply to single family residences owned by an individual. 

The amount of notice you gave is correct. What modifications have been made? If you have documentation of unauthorized modifications to the home that would stand in court potentially you can try to reserve a 60 day notice with that as a tenant at fault just cause. 

By the time that notice reaches its end if the tenant still does not move out hopefully the moratorium will be over and you can proceed with evicting them. Other options, perhaps cash for keys if this tenant might accept that?

Hi @Christy Holt, as mentioned by Dennis here as well, unfortunately if the agreement has been executed by all parties it is legally binding. What is the reasoning you would want to terminate the agreement so soon after executing it?

@Christian Rojmar Typically if it is a tenant on the lease we require a death certificate for our records so we can remove the person...with this person not being on the lease perhaps you can request it for your records for verifying her rental history in the future? That you want to be able to inform future landlords of the reasoning for her period of non payments. Seems like you have a communicative relationship with them so they may be willing to provide this to you.
