Post: Now what???? Locked into auto renew lease on townhome/bought home

@Rebekah Hitt Hi Rebekah, we have lease break conditions within our lease agreements that are very similar stipulations. If a tenant needs to terminate their lease prior to the end of the contract date they can either 1. Pay out the remainder of the lease if it is a lesser fee OR 2. Pay 50% of one months rent for our remarketing efforts and rent/utilities etc until we place a tenant. The remarketing process for us usually takes 30-45 days on average in our area. 

At our company we will typically let a tenant find someone who meets our requirements for renting the property, they must apply and we can approve to add them onto the lease. From that point you could provide 30 days to remove yourself from the agreement leaving only the new tenant on the agreement.

@Tecora White Outside of the pandemic you do have to provide 60 days of notice to your tenants because they will have been in the property a year by the end of their lease. Unfortunately there are also limitations currently with Tenant Protection restrictions. You can find information about these restrictions on the state website as well as Housing is Key. There currently has to be an at fault just cause - and you can not use non payment as a reason - you must utilize the government programs that reimbursement landlords for 100% of the back rent they are owed from the pandemic instead. At fault just cause reasons would be high amounts of damage to the home, criminal activity, unauthorized pets etc. Even if you serve a 60 day notice to vacate at this time and the tenants dig their feet into the ground and don't leave there is not much to be done with the courts at the moment.

I would recommend at this time allowing the lease to roll month to month and get your 100% reimbursement for back and future rent through the eviction moratorium period - you do not have to do an annual agreement - and then as soon as the tenant protections are lifted you can serve a 60 day notice to vacate and can evict if they do not leave.

Hi Fannie, I'm sorry to hear about your situation...and yes almost all PM's will decline to assist you with a room by room situation as you've experienced it typically gets a bit messy! We have successfully completed sheriff lockouts throughout this pandemic period as long as there is more than just money related matters. If there are other lease violations, criminal matters, etc. going on an attorney should still be able to get you through the process.

Hi Misha,

You’ll definitely want to review your lease and seem what it states about the lease break.

We have similar terms specifically outlined as lease break options for tenants in our agreements.

- Pay out the remainder of your lease

- Continue all financial responsibilities until the vacancy is filled.

If tenants do not pay this we will take from the security deposit and if additional fees are still owed it will be pursued in collections. This of course affects your credit and rental history.

If you feel as though they PMs are not trying to fill the vacancy you can attempt to dispute the funds later but if they can provide evidence they made efforts to fill the vacancy they would be justified in their actions.

Great advice from above! If you feel the settlement cannot be complete within 21 days you’ll want to mail out a good faith estimate breaking down the anticipated charges. This will buy you some time but you’ll still want to hustle from that point to finalize everything.

Post: Evicting a single tenant in a duplex during new purchase

I would assume by this point the tenant is likely month to month?

If so, the current owner can serve a 60 day notice to vacate, you could do this after purchase as well. You could also just have a discussion on if the tenant will accept a cash for keys type offer, if that will be some added incentive for her to move in.

Keep in mind that up through this point of the pandemic most of not all eviction courts are still on hold. Meaning you could open an eviction and have her served. But the process to actually move forward with having some one removed from the home would be back logged with many of the other pending evictions from the last 12 + months.
