Does anyone know a great source for phone calling scripts for various aspects of real estate? I just brought a few people on board who will be handling qualified leads and am looking for "Subject-To", "Seller Financing" and "Cash Sales" style scripts.

I used to have people sign a Sellers Disclosure that identified that I had no prior knowledge of the condition of the property and it was being sold "As-Is". Of course that didn't apply if I knew something was wrong with the property, it was then disclosed.

Google "Operating Agreement" and you should get a few decent word doc examples you can turn into a working doc for the bank. I would suggest if you really want to detail everything out, work with a local attorney to create a detailed operating agreement. If you are just starting out, you will need to show an operating agreement to some title companies, and agents, so it would be good to at least get a working doc put together.

Michael,

You should work with the title company to get the short form policy to the attorney. There really is no need for the attorney to pull title. Your short form policy that you get from the title company should be sent to the buyers attorney. When I said you have to close the attorney, what I mean by that, is the attorney will recommend to your buyer whether or not to close on the deal. Working directly with the attorney, based on the policy from the title company should be sufficient and it should save your buyer some money, as they will not have to pay for title insurance twice.

check with your title company to see if they can issue a "short-form" policy prior to close. It will be a 3-4 page document outlining the taxes, and liens if there are any, and will give the buyers attorney an outline of exactly what the title policy covers.
Anytime the buyer brings an attorney to a cash closing, you have to remember you are closing the attorney not the buyer.
