Tone Church sounds like you made out better than expected on this, congrats. Do you mind passing on some info on who you used for insurance? I am about to go into contract on a property in Westchester County NY that falls into the same scenario.

Hi BP,

Has anyone purchased a house with an existing spill violation for an underground oil tank?

I have a potential house with an underground oil tank that was previously tested and failed by a potential buyer. That buyer backed out but the spill is reported to the DEC. 

So now the house is flagged with a failing tank and the seller does not have the money to remediate. The cost of removing the tank does not concern me, but the potential of the spill spreading into nearby water tables does. 

I know there is a big risk associated, but with a big enough discount is it still worth pursuing? Has anyone structured a deal like this?
