I recommend if still possible put a condition of sale that the tenants sign a new contract with you (especially if they are related to the current owner). Be careful of such situations as it is very easy to get into a situation where you have to evict right after putting down good money to purchase the unit. Without a lease, there are extra hurdles to evict. Better to mitigate those with a lease before close contingency.

I am updating on this situation.
Eviction date (mid-may) came along and past as the property manager refused to evict due to fears of "wrongful eviction though judgement was never fulfilled. The process was started again with a new PM. After a second judgement was obtained and eviction imminent, the tenant decided they'd leave before being kicked out, perhaps because any support to keep squatting was no longer available. The tenant ultimately got another 2.5 months of free rent. To date, the old PM still refuses to return the tenants deposits for all units they were managing.
I have filed a formal complaint with the state licensing and regulatory authority. I am still shocked a property management company which advertises themselves as one of the largest in the state feels they can simply take the deposits. I will be posting a full account here once the issue comes to the conclusion desired. Hopefully this experience can be used to save others from this company and others like it.

They are definitely not doing their job.
I have cancelled my arrangement with the PM and looking elsewhere. However as they had already charged me for initiating the eviction, I wanted them to see it through. They still have to return the deposits as well as balance I keep on hand with them for minor repair.
I just want to know if legally for instance I (or a new PM) can request the tenant be removed if the current/old PM are the ones who filed the eviction proceeding with the court. I also don't want the current PM making up flimsy reasons to retain another cent from the tenant deposit before returning to me under some guise as additional cost to evict.

I would also consider letting the past $50's go. The tenant has stayed for 4yrs, perhaps the money paid to prepare the house for a new tenant had he left would have eaten away some of the back rent you are looking to pay. If you guys can align on a new rent, I think it is worth keeping a paying tenant, unless there are other reasons you would want them gone?
