I wouldn't want a tenant making demands to me. He pays me to live in my house. I make the rules not him. If he has a lease its likely not grounds for eviction but as a TAW I would give him 30 days and get rid of him or just not renew his lease. (Im in MA and not familiar w IN landlord/tenant law but I think you get my point.)

@Logan Allecyou might consider passing on the deal altogether. If the board of health or similar authority gets involved at some point in the future and the foundation damage is discovered and you did not properly fix it the house could be condemned. If you cant justify the repair either move on or ask for a price reduction to offset the cost of full repair. Also get at least one other estimate/opinion. Good luck.

Rich changing the locks in MA (self-help eviction) is a criminal offense punishable by up to 6 months in prison and up to a $300 fine. It has nothing to do with security deposit laws. If a landlord does not handle a security deposit properly they could be responsible for the payment of 3X the amount of the deposit. Just a confusion of the different laws.

Maybe a better way of saying it is that you cant convert investment/passive income to earned income (management fees).

@Sheba Shimojiwhat you are talking about doing is not allowed by the IRS. The S-Corps income passes through to you and you are solely responsible for the payment of taxes. You can't create an expense by paying your S-Corp which then reduces the amount of personal taxes you pay. Basically its all your money. You cant pay yourself.

@Rich N.its not illegal to collect prepaid rent in MA its just illegal to require/demand it. If the tenant volunteers it there is no problem.

@Mindy Jensenif the tenant prepays but breaks some other term of the lease like smoking or causing damage is the landlord still bound to this tenant? Is that a CO law?

@Armando R. landlord/tenant law is very state specific. While you have received what may sound like great advice, most comes from different states. Learn your state specific laws about damages and security deposits. Best of luck.
