Does he have possession of the property? They say possession is 9/10ths of the law for a reason......if he doesn't yet have possession, return him his money, a letter that you are not proceeding and that the lease is no longer valid and why, You should be fine. Could you be sued for possession/damages for hassle he encountered? Maybe...will he win? Maybe...if its true, but what damages were suffered? Really?...all things you want to consider, and discuss with an attorney.

Mediation is an absurd notion in this circumstance. One party has decided not adhere to their agreement. Tenant is stealing, filing is theft prevention. The tenant can mediate the eviction by paying the rent. The mediation offer is on the table. What is the intention of a second mediation? To convince a landlord to not evict for non-payment? Pass. I will charge every tenant a double deposit at move in if this happens. Cant wait to watch these tenant try to come up with it.
