Did you get a depth on the sewer line when they scoped it? Id be surprised if a fence caused the break in the line.

One thought that comes to mind that may be a work around (check with a legal rep on this), you can do a trenches repair depending on the size of the "main". Basically you dig a hole on one side of the break, which would hopefully be off the neighbors property, and you dig a second hole on your rental's property, they pull a chain through the existing sewer, then attach that chain to a poly style sewer line. They then drag the new sewer line though the old one shattering it and then make the connections to the old sewer at each hole they are working in. Thats it, they never need to dig on your neighbors property.
