Because in my state its simply illegal to market something you don't own.. and equitable interest theory that is promulgated to the public does not hold up.. 100 dollars EM with escape clauses simply is not equitable interest if you tasked to defend that position.. 

Call out the poster and make them defend themselves.This forum is actively moderated and you may be shocked how many posts are hidden and how many users are blocked.

If you document properly with pictures and/or video, it should be clear to a casual observer whether the damage is caused by "ordinary wear-and-tear" or by abuse/neglect.In every case, I personally consider whether I'm able to defend my charges in court.
