So what would be a safe way to have that conversation or would it be ok to say that, "We've received notice of smells coming from your unit?"  

I agree with Greg & Lynnette, start by having conversations with the folks at the city planning department.

So you first got in contact with a realtor, how did that conversation go if I can ask?

But I think we would all be on the same side of any conversation about landlord rights. 

I’m looking for good, trustworthy contractors in the San Antonio market for a SFR yo duplex conversion.

Their job is to help you through it so don't hesitate to start having those conversations. 

During that conversation I tell him that the home we bought was a duplex and that we were wanting to buy more properties in the future.
