Yes, if the loan is secure (I would never do otherwise). In addition to promissory note (a document explaining the terms of the loan) you get a deed of trust or a mortgage (an instrument securing the loan).

@Scott Jensen the good thing about Solo 401k is that you don't need to have a custodian!

just take the distribution, pay the taxes and you are free to use the funds as you wish

Mark, give it a try :-). Miss one payment and you will get a demand letter from your lender, late payment will be reported on your credit report and like Dmitri said they will eventually foreclose on you
