SWFL REIA General Meeting

Topic: Understanding The Real Estate Commission Lawsuits.

Federal lawsuits are challenging the way real estate agents are paid commissions. The Florida Association of Realtors and 16 brokerages are named in the seventh major antitrust case filed by home sellers since the Sitzer/Burnett verdict. A new suit seeking class-action status filed in the 11th Judicial Circuit Court in Miami-Dade County, this potential class action case accuses Florida Realtors and 16 of the largest real estate brokerages in the state of enforcing anti-competitive restraints that cause home sellers to pay inflated commissions, according to the court documents. The class representative in this case is Parker Holding Group, a firm based in Panama City that sold homes in 2021.

Speaker: BRADLEY W. BUTCHER, Butcher & Associates, P.L.

Bradley W. Butcher was born in Flint, Michigan and grew up on a small family dairy farm. After graduating from Michigan State University in 1995 with a B.A. in Political Science – Prelaw, Mr. Butcher enlisted in the United States Air Force.

Mr. Butcher served with distinction in the United States Air Force from 1995 through August of 1999 and was assigned to the 97th Intelligence Squadron based at Offut Air Force Base near Omaha, Nebraska. Mr. Butcher served as an Airborne Maintenance Technician aboard RC-135 Rivet Joint reconnaissance aircraft. Mr. Butcher was deployed to Prince Sultan Airbase in Saudi Arabia throughout his enlistment serving aboard RC-135 aircraft during operational sorties in support of Operation Southern Watch and the southern Iraqi No -Fly Zone.

In March of 1999, Mr. Butcher was deployed to RAF Mildenhall in Suffolk, England in support of Operation Noble Anvil during the Kosovo air campaign. Mr. Butcher served as an Airborne Maintenance Technician during operational sorties while deployed in support of air operations in Kosovo.

Mr. Butcher was awarded the Aerial Achievement Medal, Air Force Outstanding Unit Award with Valor and 2 Devices, Air Force Good Conduct Medal, Combat Readiness Medal, National Defense Service Medal, Armed Forces Expeditionary Medal, and Air Force Training Ribbon during the course of his service in the United States Air Force.

After leaving the United States Air Force in 1999, Mr. Butcher attended the Thomas M. Cooley Law School in Lansing, Michigan where he pursued the study of law. Mr. Butcher completed an accelerated curriculum and graduated September 15, 2001 first in his law school class.

In April of 2007, Mr. Butcher formed Butcher & Associates, PL. to provide quality legal services in Charlotte, Collier, and Lee Counties.

June 24, 2021, at approximately 1:22 a.m, Champlain Towers South, a 12-story beachfront condominium in the Miami suburb of Surfside, Florida, United States, partially collapsed, causing the deaths of 98 people.

In May 2022, the Florida legislature passed Senate bill 4-D – Building Safety, informally known as the Florida Condo Safety Act. This legislation puts in place state-level mandates for inspection and reinspection of condominiums.

Bruce Norris is an active investor, hard money lender, and real estate educator with over 35 years of experience. Bruce has been involved in more than 2,000 real estate transactions as a buyer, seller, builder, and money partner.

Renowned for his ability to forecast long-term real estate market trends and timing, the release of The California Comeback report in 1997 gained him much notoriety.
