@Jeff J. I would not have paid her. Period. The deposit is supposed to be used for damages to the property. I don't imagine MN differs that much. Here in WV the Landlord has to notify tenant within 30 or 60 days (which ever the lease states) How much of the deposit is being returned and an itemized list of what was deducted from it.

You should have saved yourself $600. Don't let another Tenant push you around. Legal Savvy....she probably never even filed a case.

3. SECURITY DEPOSITS

Landlords have the right to require tenants to pay a security deposit (sometimes called a damage deposit). This is money paid by the tenant and held by the landlord to pay for any damage beyond ordinary wear and tear the tenant might do to the rental unit, any unpaid rent, or any money the tenant owes to the landlord under some agreement. Minn. Stat.

@Kalo (Kyle) Atanasoff West Virginia is another good state for Landlords. Filing is less than $70. Court within 2 weeks and if landlord is awarded eviction tenant has to vacate within 10 days!

@Michael David I agree with some of the other posts. A normal month to month tenant in violation (pets) would likely be an easy eviction. Then you factor in Section 8 and local regulations in regard to section 8....yeah. No. That wouldn't be me. I would talk to the seller or sellers agent about your concerns and have the issue resolved prior to closing. Good Luck

 Ha Glad to see/hear someone thinks the same way I do. Was it at least a nice picture hanging there? A quit-claim would work but as you said in your post, she may not easily sign. Then again it has been 23 years. She very well could have gone after some interest in the property during that time frame but did not. It may just take the right person talking to her.

 I am very interested in WV. Actually WV is one of my larger motivators for trying to network in the larger metro areas. If I can get myself in the correct position WV has an over abundance of abandoned properties and rehad possibilities that I would LOVE to get my hands on.

Pardon my ignorance in this matter but if the seller has a divorce decree stating he gets the house in his divorce settlement couldn't he go to the local county and show them the court order and have her removed?

I agree with @Daniel Mohnkern. If it were a different situation (buying from unknown seller) I would likely use a Realtor but being that it is your mother in law it would be much more cost effective and easy if you were to go directly to a Title company or Lawyer.

Also I am from Maryland originally. Have you looked into comps in the area and factored in the need for cosmetic work in the purchase price? I can completely understand the desire to not want to insult her with a low offer for the property but it also has to make sense on paper. Then again that is just my opinion. Call around to a couple title companies to get a feel for the process. Most are very friendly and willing to help and answer questions. I've dealt with Olde Town title in Frederick, MD. Good group there
