The nuances of this article can be lost. This article is saying that you have to have intent to purchase. What this means is that if you do not have the ability to purchase the property, you are not wholesaling it properly.

This is a HUGE issue with how wholesaling is currently being taught online. Get it under contract and assign the contract is fine - as long as you are able to purchase the property if you cannot find someone to assign the contract to.

@Andrew Johnson, I've seen this question asked before - and even had it in my own head before I learned the rules. 

It can be easy to think, "Who cares? I'm only lying to a bank, not an actual person." (That was my thought.)

But when I found out that it is a felony, that stopped me as I hope it stops you. A felony conviction isn't worth it to me. 

You asked about the legalities, and that's what this site is for, to learn. 

Playing Devil's Advocate, will they catch you? I don't know. No one ever came to my house to make sure I was living in it. But that doesn't mean they won't come to check on you.

Now that you've been made aware of the laws surrounding owner occupied loans, you can make an informed decision on how best to move forward.

@Jeff Z. if you've never purchased a property before, I would recommend buying the first one WITH an agent. Take detailed notes, and buy your second one without an agent if you feel you can handle it yourself, but there is a lot involved with buying a house and I'd hate for you to not be represented your first time out.

Two thumbs down for removing the thread that was critical of the new format.  Maybe it was removed because with the revert to the previous forum format, BP thought it was no longer relevant.  If this is the case, I do not agree.  There were many posts that pointed out features of the forum that they found valuable (many of which the new format did not provide).  

In addition, removing the thread provides the perception that BP may have removed it because of the criticism of the new format and maybe looking at it as a criticism of BP.  My own view is if there are never any issues that it typically is a result of a conservative approach that is likely not to result in the product improving.  I do not look at the poor forum update as implying BP has a significant issue.  They tried something and IMO it was not a good change.  I suspect BP was hoping their users liked the forum update and one way to find out is to try the update.

My first day skiing, I suspect I broke the record for most crashes ever on a ski slope.  My step-sister and her friend crashed a couple of times.  In one day (my second day on skis) I was literally skiing circles around them.  They were still on the bunny slope and I was going to the top of the mountain (doing the easier runs from the top of the mountain, but to make the top of the mountain on the second day was very good).  My step-sister stopped skiing within a year and was still a long way from being able to go to the top of the mountain.  The point is pushing the limits can result in greater growth than taking the conservative route and that there is nothing wrong with some minor setbacks.

We kept the thread available to review internally, but pulled it from public view so as not to confuse people who may have missed the changes. Thanks for your feedback, Dan!
