This is a trying one. There is a lot to look at with a project like this. I would try to see if there are any experienced development consultants that know the ins and outs of the city and its codes to advise you.

From (demand, path of progress, leed  time to demand) the sound of things I would expect the pricing to be the other way;pay for resi,commercial free.

The de facto is Argus, but it's very expensive.

I saw this done with a mechanics lien, in CA so I don't know if it applies. The title company "bonded around" the defect in title, that the property could go thru forclosure and be sold.

The one I tried to do a deal with had a bunch of the own require. Check that the operator your looking at would accept a conversion.

How can a state law supercede a federal law.I don't believe it can. it's the reason CA's very strong anti-spam law has been watered down, and the Federal CAN/SPAM prevails.

The law can say let's play nice, but that's just words. If had some cash to invest I would be knocking on my nephews door in CO. But for me, 4M is to be a risk. I would be looking at entry level property. With federal asset forfeiture laws and zero tolerance,wow. Just Look how  the "legit" dispensaries in Oakland where treated UNDER the prez.

Have any of you looked into the HOA superlien as a way of breaking into market? Or is this a process that looks great on paper, but is difficult to implement?

My concern is that MJ is still illegal under federal law. Yes, the prez did tell the DEA to back off, but there might be a new prez in 2017 or 4 more years.

I haven't kept track on how his"executive order" method of lawmaking is surviving the test.

I would expect to have to make a tentative map and possible a subdivision map, depending on what I was doing. I wonder if the is a terminology issue governing body. 

As Kaite said, I would also expect a change to the zoning (at least) and maybe the general                   plan.

Ask if you can use a PD, PUD, Planned development process which is the "new more flexible way to do this", even though it's going to be commercial, not condos or residential.

This loan servicing would likely be done w/ pencil and paper or a Quicken "loan" account. I would say hiring a servicer for a "friendly" transaction to be too costly.
