I wouldn't say anything about his smoking or his health.  You are just opening up yourself to a sob story and excuses.  He is month to month, just give him the notice of non-renewal.  Keep it as simple as possible.  You have the health and well being of your other tenants to watch out for.

I agree.  New Laminate, paint cabinets and new hardware should do the trick.  Is the flooring in good shape?

I'm glad it worked out the easy way for you.

HUD allows two occupants per bedroom. I do not believe you can deny a two bedroom apartment to a family of four based on occupancy laws. I also believe that if you have a 3X rent requirement for your rentals and then have an additional amount required per occupant this could be discriminatory towards families.

I've seen lots these in my area.  They are great for urban areas because they have a smaller footprint.  It wouldn't be my preference for my personal home but it wouldn't stop me from buying it as an investment property.  There is still a lot of interest in these types of places, despite the immediate steps.

Unless the lease states the ways that rent can be increased, then you can't legally raise the rent until the lease ends.  

I would never give a PM withdrawal access to my account.

I would agree with @Rogers Smith the assignment of your property management without your approval is a deal breaker.  The 5% commission on the sale is also a deal breaker for me.  Why would they get a 5% ownership of your house?  The 10% fee is typical in my experience.

You could hold them to the current lease and then sign an addendum for the unit open June 30th when it becomes available.  They would have to be okay moving twice.
