Get your lawyer to paper the deal, but it sounds like a typical private mortgage loan. Lender gets a promissory note and a first mortgage lien. Rates vary from place to place. 12% plus points is pretty standard. Good luck.

You may want to take your favorite title agent to lunch and pick his or her brain, but I think you will find that they have long since gone automated and that their processes are quite efficient.
