After doing my research calling Probate court and my title company, after all you guys advice and explaining to seller what steps he needs to take for Probate. He emailed me tonight and says he is going in a different direction because he found an investor that going to pay him more. LOL!! He doesn't know that I know that he hasn't spoken with his sister in a year and apparently she's on the Will.

@Ned- Thank you! I contacted my title company and the Probate court to get further info. I passed the info along to the seller. Now the ball is in his court...He has some work to do!!....... I have learned something new which will always be valuable to me. I thank you all! I love BP!!

Brian P. @He says his lawyer told him it would cost $400 to change the name on the deed. If he has the Will will he still have to change the name on the deed? Is it true without Probate the son has no legal power?
Brian P. if the Will has his name on it, is he considered the owner? Does he have to register with Probate Court?
Jon Holdman Tom Goans- Thanks, you guys are the best! I have learned a valuable lesson. And putting this house under contract was my way of learning some things. I have learned to valuable lessons about REPAIR COST & DEEDS that will help me in my journey of RE! I'm one of those people that has to be hands on. I learn better.

I have a property under contract with a gentleman. I failed to ask who's name the deed was in and of course it's in his deceased mom's name. How will this affect this deal? Now that I know this information is there anything I need to do to move forward?
