Hi @Joe Farrance, good questions! Please clarify if you are working on Foreclosures or Pre-foreclosures. 

(1) You may have an issue wholesaling a property that is listed, when a buyer can go around you ot the agent. But you can ask about the agreement and see if they will sign, along it may not hold weight with agency law. You will have a better chance of creating an agreement with your buyer. Are you a real estate agent yourself?

(2) If it's a preforeclosure, you could still reach the owner. But you will have challenges if the property is listed with an agent. If it has been foreclosed on, now it's owned by the bank. 

(3) You can reach out to the agent to view the property. They will need to show it to you, if you are not licensed.
