@Lauren K. It really depends on the terms of your lease.  If the lease allows you to bring an eviction action for these actions then make sure that you comply with NJ law so that it is not an illegal eviction.

@Marta K.   There is no statewide rent control ordinance.  That said Cliffside Park does have a rent control ordinance and the amount you may raise the rent and/or levy a fuel surcharge at the time a lease is renewed is outlined in the local ordinance.  (Ordinance No. 11)

@Daniel Velez New Jersey law does not prevent you and your tenant from agreeing to changes and signing an amended lease before the expiration of the current lease.  However, a landlord cannot unilaterally make changes to a written lease while that lease is in effect.  (See the New Jersey Department of Community Affairs Division of Codes and Standards most recent Lease Information Bulletin)   The tenant has the legal right to decline the amendment.  

It would also depend on the language of the lease currently in effect whether any changes could be made.  The terms of the lease largely govern actions both a landlord and/or tenant can take.

@John Kirk    as others have stated it depends on why the seller is selling.  There is no one strategy to convince a seller to accept the deal you are offering.  They will make their decisions based on their own reasons.  Without knowing more information it is hard to give advice on the negotiating strategy you should use.

@Justin Eaton @Stephen Kappre   As an attorney representing clients in the area I can confirm that these issues are more prevalent than they should be.  I have advised clients that the best bet is to walk away when too many of these problems exist.  

The part that always gets me is that by having the deal fall apart because of these issues the flipper now has to remediate the problem or disclose the issue before the next deal.  Otherwise, they might be liable for fraud.  Doing it right the first time can be more profitable in the long run.
