You have a tenant that happens to be your niece. Follow your states protocol for eviction. Maybe you can get her parents to help her out. Cash for keys might work.

We applied w/TD for a small HELOC aboy 10 days ago. On our primary. For reno. Their appraisal at 360, 2nd position.

94k first mortg. 5k total cc debt  3 years tax returns. Self employed. 805 FICO. Our rental is free and clear at 385000 value.  Received conditional approval, week ago Friday. 

Monday AM received denial.

Denial stated 100k applied for which was wrong. Salesman would not write what we asked for [30] and wrote app for 100 but changed after we rejected it.

Early last week it wa reported in financial circles that JPMorgan. WFargo. & the other big banks issued warnings, shut down helocs a d tightened primary mortgages to 20 % down and add'l tightening.

We emailed at 6pm. Looking for corrections and review. Crickets. No reply all week.8

In many states if this got in front of a court you would likely lose and in some jurisdictions a judge could very likely figure you had constructive notice and order the deposit returned

Others more experienced than I may know better but it looks like a rotted out countertop or the flooring of the cabinet

I would run my business. When they share in your losses they can share in your profits.

Oh yeah. They failed to live up to their obligations already.

Loan originators are not loan underwriters. If it were me I would pay as agreed until unable to do so.

No one protects or cares about you....but you. Make getting the estoppel letter PRIOR to closing part of the deal.

I am/was no fan of this. OTOH 20.00 per month compared to newspaper prices loooong ago is cheap.

With said my thoughts have been turning to a concern....about the response rate.  So many "I'm interested" responses that all go ghost and/or never reply and similar stories from LL's across the country gets me to suspect A/I or just BS replies to skew the metrics and response rates that the hapless LL's just cannot convert.

Your experience may be different.
