@Bon Donaldson you havent said what the first lien UPB is. I would have the first position lien to his property. Treat it as a business, this is very important. Not sure how many loans you have originated this year, but make sure you are Dodd Frank compliant as this is his primary residence.

If you can sell it for a profit, then that is the route to go. This is what @Michael Swan has been talking about in another thread today. https://www.biggerpockets.com/forums/62/topics/394...

There are other places where you can get a better return on your investment.

Yes, it is a hassle to have it a LLC's name as long as you have more properties. If it is just a handful, have it in your personal name and get a umbrella policy.

Have you ever considered investing in notes than having a rental?

@Sandy Uhlmann, do you want to share your experience on why it was disappointing? Was it the huge seconds that you bought more than a year ago (if my memory serves correctly)?

What are the pitfalls that others can avoid? Im mostly into 1st PN and 1st NPNs.

Ive invested in OH, IN, SC, NC. You dont have to travel to purchase non-performing notes, but i would suggest you get some training so you have some sort of network to help you in other states.

Typically funds would give you a yield of 12%. Why not you work the notes and get a better return? If you would like to meet and discuss, message me offline.

See if you can sell it back to the seller from whom you purchased at the first place. Find out what kind of price they would be willing to give you.

option 2: How about you do a JV deal with someone who is working on a non-performing asset and split the profit 50-50. We do that with other investors.
